Fla. supports Ariz. immigration law in court brief
South Florida Business Journal
Florida has joined eight other states in filing a friend of the court brief that supports the Arizona immigration law that's being challenged in federal court by the U.S. Department of Justice.
“I support the current law in Arizona, and I support efforts to see a similar law brought to our state,” Florida Attorney General Bill
McCollum said in a statement. “Seeing no action or leadership from the federal authorities, Arizona has every right to move to protect its citizens, and for this they are being sued by the president.”
McCollum said he is working with state Rep. William Snyder, R-Stuart, to develop a Florida immigration law. An unscientific South Florida Business Journal Biz Pulse survey found 72 percent of respondents favor such a law. The Justice Department is arguing that Arizona’s law is pre-empted by federal law, while the states' friend of the court brief argues that Arizona's enforcement effort is consistent with federal law.
The states "have the power to concurrently enforce federal immigration law, provided that the states do not create new categories of aliens or attempt to independently determine the immigration status of an alien," the brief argues. The brief says the federal lawsuit seeks to invalidate the existing power of states to verify a person's immigration status.
The brief argues that Congress has directed federal immigration officials to respond to state inquiries seeking to verify citizenship status of individuals, so federal law presumes that state law enforcement officers have inherent authority to inquire about the immigration status of people within their borders.
Other states participating in the friend of the court brief are Michigan, Alabama, Nebraska, Pennsylvania, South Carolina, South Dakota, Virginia and Texas. The territory of the Mariana Islands also joined in.
